MindShiftIQ Terms of Service

1. Agreement to Terms
By accessing or using MindShiftIQ ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including business owners, clients, and administrators.
2. Description of Service
MindShiftIQ provides AI-powered marketing automation tools for local service businesses, including but not limited to: automated content generation, social media scheduling, lead follow-up via SMS, Google Business Profile management, ad campaign creation, video generation, and reputation monitoring.
3. Subscription and Billing
Access to MindShiftIQ requires a paid subscription. Fees are charged on a recurring monthly or annual basis. You authorize us to charge your payment method on file. Subscriptions renew automatically unless cancelled before the renewal date. No refunds are issued for partial months.
4. SMS and Communications
By using the AI text-back and follow-up features, you authorize MindShiftIQ to send automated text messages on behalf of your business to your leads and customers. You are responsible for ensuring your use of SMS communications complies with the Telephone Consumer Protection Act (TCPA) and all applicable laws. You must have proper consent from recipients before enabling automated messaging.
5. AI-Generated Content
Content generated by our AI tools (posts, ads, blogs, video scripts, etc.) is provided as a starting point. You are responsible for reviewing and approving all content before publication. MindShiftIQ is not liable for any content published through the autopilot feature without your review.
6. Third-Party Integrations
The Service integrates with third-party platforms including Google, Meta, TikTok, LinkedIn, Twilio, HeyGen, Retell AI, and Stripe. Your use of these integrations is also governed by each platform's own terms of service. MindShiftIQ is not responsible for changes, outages, or policy violations on third-party platforms.
7. Acceptable Use
You agree not to use MindShiftIQ to send spam, engage in deceptive advertising, violate platform policies, or publish content that is illegal, defamatory, or harmful. We reserve the right to suspend accounts that violate these terms without refund.
8. Data and Privacy
We collect and process your business data as described in our Privacy Policy. You retain ownership of your business data. We do not sell your data to third parties.
9. Limitation of Liability
MindShiftIQ is not liable for lost profits, missed leads, or business losses resulting from service outages, AI content errors, or third-party platform changes. Our total liability is limited to the amount you paid in the prior 30 days.
10. Termination
You may cancel your subscription at any time from your billing settings. We may suspend or terminate accounts for violations of these Terms. Upon termination, your data will be retained for 30 days before deletion.
11. Changes to Terms
We may update these Terms from time to time. We will notify you by email of material changes. Continued use of the Service after changes take effect constitutes acceptance.

MindShiftIQ Privacy Policy

1. Information We Collect
We collect information you provide when setting up your account, including: business name, address, phone, and website; owner name and contact information; payment information (processed securely via Stripe — we do not store card numbers); connected platform credentials (Google, Meta, etc.) via OAuth; and lead and customer data entered into or captured by the platform.
2. How We Use Your Information
We use your information to: provide and operate the MindShiftIQ platform; generate AI marketing content tailored to your business; send automated SMS and email communications on your behalf; process billing and subscription management; improve platform features and reliability; and send you product updates and service notifications.
3. SMS Data and TCPA Compliance
When you use our AI text-back or follow-up messaging features, we send SMS messages to your leads on your behalf using your Twilio integration. You are the sender of record. We store message logs to help you track communication history. We do not use your customers' phone numbers for our own marketing purposes.
4. Third-Party Services
We integrate with and transmit data to the following third-party services to provide our platform: Stripe (payment processing), Twilio (SMS delivery), OpenAI (AI content generation), HeyGen (AI video generation), Retell AI (AI phone receptionist), Resend (transactional email delivery), and Google, Meta, TikTok, LinkedIn (social posting via OAuth). Each of these providers has their own privacy policy governing their data practices.
5. Data Retention
We retain your business data for as long as your account is active. After cancellation, data is retained for 30 days before permanent deletion. You may request early deletion by contacting us.
6. Data Security
We use industry-standard security practices including encrypted data transmission (TLS), secure credential storage, and role-based access controls. OAuth tokens for connected platforms are stored securely and never exposed to other users.
7. Your Rights
You have the right to access, export, or delete your data at any time. To exercise these rights, contact us at hello@mindshiftiq.com. We will respond within 30 days.
8. Cookies
We use cookies and local storage for authentication sessions and platform functionality. We do not use third-party advertising cookies. You can clear cookies through your browser settings, which will log you out of the platform.
9. Children's Privacy
MindShiftIQ is a B2B platform intended for business owners and is not directed at individuals under 18. We do not knowingly collect data from minors.
