By accessing or using MindShiftIQ ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including business owners, clients, and administrators.
MindShiftIQ provides AI-powered marketing automation tools for local service businesses, including but not limited to: automated content generation, social media scheduling, lead follow-up via SMS, Google Business Profile management, ad campaign creation, video generation, and reputation monitoring.
Access to MindShiftIQ requires a paid subscription. The standard plan is $399 per month. New subscriptions begin immediately, with the first payment due at checkout. Fees are charged on a recurring basis. You authorize us to charge your payment method on file. Subscriptions renew automatically unless cancelled before the renewal date. Your first subscription payment is covered by a 30-day money-back guarantee. If you are not satisfied, email hello@mindshiftiq.com within 30 days of your first payment to request a refund of that subscription payment. Canceling renewal alone does not submit a refund request. Outside this guarantee, no refunds are issued for partial months. Advertising spend and separately approved provider usage are billed separately from the subscription.
MindShiftIQ text notifications send participating business owners automated approval requests, account alerts, and service updates. You enroll by actively choosing text notifications for your mobile number in your account settings or during onboarding. Message frequency varies with account activity. Message and data rates may apply. Text notifications are optional, and consent is not required to purchase a subscription.
Reply STOP to unsubscribe and HELP for help. For assistance, email hello@mindshiftiq.com. You can also turn text notifications off in your account settings. Carriers are not responsible for delayed or undelivered messages. Our Privacy Policy explains how we protect mobile information and messaging consent.
Customer-facing text-back and follow-up messages sent for a participating business use that business's identity, consent process, and registration. The business must obtain the recipient's permission before enabling automated customer messages. Enrolling in MindShiftIQ account notifications does not enroll anyone in a client's customer messaging program.
Content generated by our AI tools (posts, ads, blogs, video scripts, etc.) is provided as a starting point. You are responsible for reviewing and approving all content before publication. MindShiftIQ is not liable for any content published through the autopilot feature without your review.
The Service integrates with third-party platforms including Google, Meta, TikTok, LinkedIn, Twilio, HeyGen, Retell AI, and Stripe. Your use of these integrations is also governed by each platform's own terms of service. MindShiftIQ is not responsible for changes, outages, or policy violations on third-party platforms.
You agree not to use MindShiftIQ to send spam, engage in deceptive advertising, violate platform policies, or publish content that is illegal, defamatory, or harmful. We reserve the right to suspend accounts that violate these terms without refund.
We collect and process your business data as described in our Privacy Policy. You retain ownership of your business data. We do not sell your data to third parties.
MindShiftIQ is not liable for lost profits, missed leads, or business losses resulting from service outages, AI content errors, or third-party platform changes. Our total liability is limited to the amount you paid in the prior 30 days.
You may cancel your subscription at any time from your billing settings. We may suspend or terminate accounts for violations of these Terms. Upon termination, your data will be retained for 30 days before deletion.
We may update these Terms from time to time. We will notify you by email of material changes. Continued use of the Service after changes take effect constitutes acceptance.
